
Below you will find the details and terms of service outlined by Lucy Digital. Any client who agrees to work with Lucy Digital is agreeing that they have read and understand all of Lucy Digital's terms of service.
Lucy Digital has the right to update and change these terms at any time.
TERMS & CONDITIONS
Payments, Booking and Communication
All services carried out by Lucy Digital require payment upfront prior to the start of any service being provided by Lucy Digital unless otherwise agreed. If payment is not made, your project will be void and service cancelled.
All payments are non-refundable.
If payment is not made, Lucy Digital has the right to void and cancel your project.
Printing services provided by Lucy Digital, also require FULL PAYMENT to be made upfront, prior to the service being provided. Printing will not be processed until full payment is made.
Payments are made by direct bank transfer to Lucy Digital.
Lucy Digital does not accept refunds.
Lucy Digital has the right to update and change the cost of all services at any time.
Prices quoted/shown do not include any future design amendments. These will be charged at an additional fee unless otherwise agreed at the time of booking.
Bespoke quotes are given to individuals based on their specific needs and are not set prices for other clients.
If you contact Lucy Digital on three separate occasions without providing a reply, Lucy Digital reserves the right to refrain from responding to you or accepting you as a client. In addition, this policy also applies to individuals who submit their design brief, and agree to payment terms but fail to complete their payment. If a client fails to pay their agreed fee on more than two occasions and requests to rebook or engage in further communication, Lucy Digital reserves the right to refrain from responding to you. This policy is in place to prevent time wasting for both parties.
By agreeing to your offered booking date(s), you are agreeing that you are available to respond to Lucy Digital promptly (within 1-hour) to give feedback and finalise your project.
Lucy Digital has the right to withdraw from working on your project if a timely response is not given. If you do not respond to Lucy Digital within 24 hours after your designs are sent for feedback your project may be void and you will not receive a refund or you will receive a time-wasting fee.
A time-wasting fee of an additional 50% of the project fee will be added to any project where the person responsible/the person booking does not respond in a timely manner (a timely manner being within the hour of your designated booking time slot), requests a new/different design brief from the original communicated or any other reason where Lucy Digital's time is not taken into consideration.
Turnaround times vary per booking/service. This will be discussed with each client before the commencement of any service being carried out.
Lucy Digital does not accept voice notes when you're providing a project brief or as a means of communication.
Communication must be via written messages. This ensures smoother communication and allows Lucy Digital to better understand your vision.
Lucy Digital does not accept any abusive, patronizing, or aggressive behaviour or communication. Lucy Digital reserves the right to terminate your service should such behaviour arise.
If such behaviour results in the termination of your booking, and your project has already been started or provided, there will be strictly no refunds.
For ongoing services (e.g. website hosting, social media management, bespoke package agreements), Lucy Digital reviews service pricing annually in December, with any adjustments coming into effect from January 1st of the following year. This review reflects changes in operational costs, industry standards, inflation, and the evolving scope of services provided. Clients will be given a minimum of 30 days' notice prior to any change, ensuring transparency and time to review any updates to their agreement.
Cancellations, Late Fees, and Rebooking Fees
If you decide you need to cancel your project after payment is made, and your project hasn't been started yet, you will lose 50% of the payment made and will be refunded 50% of your total payment.
If you request to cancel AFTER your project has started, you will NOT be refunded any of the amount.
The only exception to this cancellation policy will be when Lucy Digital may have to cancel your booking due to unforeseen circumstances. If such events do occur, you will be offered an alternative booking day or a full refund.
If you miss your booking day, regardless of the service selected, a rebooking fee of 50% of the total service cost will be necessary to reschedule your booking to the next availability.
Failure to pay the rebooking fee will result in the cancellation of your original booking and the inability to secure a new appointment.
Failure to pay the rebooking fee will result in you not being refunded your original payment and all designs will be removed from Lucy Digital's system.
In accordance with the Late Payment of Commercial Debts (Interest) Act 1998, Lucy Digital reserves the right to charge interest and compensation on any overdue invoices. If payment is not received by the due date stated on the invoice, the following will apply automatically and without further notice:
Statutory interest will be charged at 8% above the Bank of England base rate, calculated daily from the day after the payment was due until the invoice is paid in full.
A fixed late payment compensation fee will also be applied based on the total value of the invoice:
£40 for debts up to £999.99
£70 for debts from £1,000 to £9,999.99
£100 for debts of £10,000 or more
These charges are enforceable under UK law for business-to-business transactions.
Websites
The following terms and conditions apply to all website design services offered by Lucy Digital. By ordering services from Lucy Digital you are agreeing to the following terms and conditions:
Lucy Digital reserves the right to refuse to construct a website that Lucy Digital may judge as unfit due to the content or otherwise. This includes but is not limited to, sites containing adult-oriented material such as pornography, sites that promote hatred towards persons belonging to any ethnic group, religion, or sexual orientation, and sites that infringe the copyright or are contrary to UK laws.
All material, both text and images supplied by the client and used in the construction of the client’s website, will remain the client’s property. All such material will be assumed to be the property of the client and free to use without fear of breach of copyright laws. Lucy Digital will not be held responsible for any copyright infringements brought against the client for images supplied to Lucy Digital by the client.
Lucy Digital makes every effort to design pages that display acceptably in the most popular current browsers but cannot accept responsibility for pages that do not display acceptably in new versions of browsers released after pages have been designed.
Lucy Digital submits a client’s website to several of the major search engines as part of the design fee. Lucy Digital cannot guarantee high positions in search engine results.
If, during the Website Development Cycle, the client does not supply the content required in order to complete the service within a reasonable amount of time, Lucy Digital will consider that the client wishes to cancel the service and will not be eligible to receive a refund either in full or part.
Lucy Digital will not be held responsible if the client's chosen domain name is not available at the time of registration.
Lucy Digital does not undertake to maintain or update a client’s website as part of the design fee. If a client wishes Lucy Digital to maintain or update a website as a separate fee, Lucy Digital will discuss with the client a maintenance contract appropriate to the amount of work required.
Any images supplied by Lucy Digital for the construction of your website are to be solely used for illustration for the website built and not to be reused for any other forms of advertising, marketing, or social media. You do not have the right to use any 3rd party images licensed by Lucy Digital. These images must be replaced with your own imagery.
Any design times specified by Lucy Digital are subject to change at any time in the design process.
Lucy Digital uses but is not limited to the following software to design and create websites: Wix Studio and Shopify.com. Please familiarise yourself with their terms and conditions.
If you wish to terminate your service with Lucy Digital, your website will be taken offline, and hosting cancelled. To discuss a separate handover please contact Lucy Digital with at least 1 month's notice to discuss the transfer of hosting (Wix or Shopify unless otherwise stated) and domain name.
Design and File Storage
The following terms and conditions apply to all graphic design services offered by Lucy Digital. By ordering services from Lucy Digital you are agreeing to the following terms and conditions:
Lucy Digital aims to ensure all clients are 100% happy with their designs. If you are unhappy with your design samples then Lucy Digital will work with you until we create something you love. However, if you wish to have new samples created based on a new brief you will need to repay the design fee.
All design projects come with 2 rounds of amendments. Additional amendments will incur further charges. The charges will vary depending on the size and complexity of the project. Please ask Lucy Digital prior to the start of your project how much additional amendments on your project will cost.
All files will be removed within 2-weeks of them being transferred over to you. It is vital that you save them as soon as possible. It is also recommended that you save the files to a backup device.
If you require Lucy Digital to keep your files for longer than the time scale provided such as if you know your design will need updating e.g. price list, please request this when you are booking your project.
Printing
The following terms and conditions apply to all print services offered by Lucy Digital. By ordering services from Lucy Digital you are agreeing to the following terms and conditions:
You are responsible for the proofing of your designs before they are sent to print (spelling, punctuation § grammar). Please ensure you check over your designs carefully before you approve them.
Lucy Digital is not responsible for your prints once they have been shipped.
Proof of postage is always provided if Lucy Digital ships your prints, however, all responsibility will be with the courier whom you will need to contact yourself directly.
Lucy Digital is not responsible for any colour variations when your order has been printed. Colours may differ when your digital design is physically printed due to the difference in colour modes.
When Lucy Digital is delivering prints directly to you, delivery times may vary from the agreed estimated delivery date and time.
Photography
The following terms and conditions apply to all photography services offered by Lucy Digital. By ordering services from Lucy Digital you are agreeing to the following terms and conditions:
All photography sessions will be planned before the agreed booking day.
Cancellation on the day of the agreed service will result in loss of payment and an additional booking fee will be required to rebook the service.
A 50% deposit is required when booking and the final 50% is due before your content is sent over to you.
Lucy Digital reserves the right to use all footage taken for marketing and promotional materials of Lucy Digital's services.
Lucy Digital reserves the right to immediately terminate any content shoot if the conduct of those in attendance is deemed inappropriate, abusive, aggressive, or unsafe. This includes but is not limited to, verbal or physical abuse, offensive behaviour, or any actions that put the photographer, equipment, or others at risk. In such cases, no refunds will be issued, and the photographer’s decision to terminate the session will be final.
Rescheduling due to weather conditions or unforeseen circumstances will be accommodated where possible.
The client is responsible for providing access to locations, securing permissions (if required), and ensuring subjects are ready at the scheduled time.
Each shoot includes a minimum number of professionally edited photographs as outlined in the pricing. While many shoots will exceed this number, the minimum is in place to protect expectations on smaller or highly specific briefs, for example shoots focusing on a single subject, static product, or staged area. Shoots that involve natural working environments or more general activity often result in a much larger gallery of final images.
Unedited/raw files will not be provided unless agreed upon in writing before the shoot. RAW video (only) files are available upon request as an optional extra. RAW video files are completely unedited and are provided exactly as captured in-camera. They have not been colour graded, stabilised, cropped, or adjusted. RAW files are typically only provided in rare instances within the photography and videography industry and are not intended to be shared publicly in their raw format. If you choose to request RAW footage, you agree that it is not to be presented or judged as a finished product and cannot be shared in a way that reflects on the creator’s professional standard. These files are intended for internal or editing use only.
Final edited content will be delivered via Google Drive/download link within 10 working days of the shoot (unless otherwise stated).
The client may not sell, resell, or distribute the images for third-party commercial purposes without written permission.
If sharing the content on social media, the client is encouraged to credit/tag @lucydigital.co.uk where possible.
Additional fees apply for extended shoot durations, extra edited images, or additional video clips beyond what is agreed upon at booking.
While every effort will be made to capture high-quality content, Lucy Digital is not liable for factors beyond their control, including weather, client delays, or technical malfunctions.
In the event of an emergency or unforeseen circumstances preventing the photographer from attending the shoot, the client will be offered a full refund or a rescheduled session at no extra cost.
If your photography session includes members of the public, including your clients, photography permission must be gained before the photography session can commence and it is the client's responsibility to ensure they have the consent of all individuals being photographed. Lucy Digital will not be held responsible for any failures to receive consent, and this responsibility is solely with the person booking the photography session.
All files must be saved by the client, Lucy Digital does not store images once transferred over to the client.
By booking a content shoot, the client confirms they have read, understood, and agreed to these Terms & Conditions.
Social Media Management
The following terms and conditions apply to all social media management services offered by Lucy Digital, unless otherwise agreed before the commencement of your package. By ordering services from Lucy Digital you are agreeing to the following terms and conditions:
Lucy Digital will not be answering DMs.
Lucy Digital will not be held responsible for any missed messages or responses.
All of the information for the content must be provided by yourself, unless otherwise agreed.
Content for the upcoming month must be given at least 2 weeks in advance. Lucy Digital will not be held responsible if a last-minute content request (within 72 hours) cannot be fulfilled.
All content must be approved by yourself before being posted to social media channels unless you agree you are happy to not be part of the approval process (all content will be scheduled using Meta Business suite or similar).
Lucy Digital cannot guarantee specific results i.e. 100 new followers every month, 100 likes on every post.
This service aims to give consistency to your social media, to improve your online presence, and Lucy Digital will provide the best service possible with the information provided.
Payments are made a month in advance of any work on the last day of the previous month for social media management. Any payment failure will result in cancellation/no further action. I.e. payment on the 31st of December pays for the service throughout January, payment on the 31st of January will be payment for February's service, and so on.
Approval for the work to commence and payment of the service agreed upon indicates that the client accepts all terms and conditions outlined in this document.
Payment is due within 24 hours of you receiving your invoice.
All communications/correspondences will be via email or WhatsApp. It is the client’s responsibility to keep Lucy Digital updated with their relevant email addresses and contact details.
All information provided to Lucy Digital such as strategy documents, account details, and passwords are confidential and will not be shared.
By agreeing to this service and giving payment, you agree to give Lucy Digital access to the accounts discussed including usernames and passwords (if necessary).
If you wish to cancel the service, please give at least 2 weeks' notice before the next month's payment date.
Any additional service not included in your package will incur additional costs.
Content posts are charged at £20 per post if you wish to go over your agreed package post limit.
The price of your package does not include any paid social media advertising budget unless otherwise agreed.
If you do not use your total weekly post allocation i.e. you only use 4 posts instead of your 5 limit, this does not roll over onto the following week. Unless otherwise discussed in advance.
Lucy Digital has the right to alter the cost of your package or invoice you separately if additional services or time spent are/is added.
Lucy Digital has the right to terminate this contract at any time if the T&Cs are not followed.
Payment is nonrefundable.
UK-Compliant Copyright & Usage Terms
1. Copyright & Ownership
All photographs, videos, and digital content created by Lucy Digital are protected under the Copyright, Designs and Patents Act 1988 (UK).
Lucy Digital retains full copyright on all content unless a separate written agreement transfers ownership.
2. Client Usage Licence
Upon full payment, clients receive a non-exclusive, non-transferable licence to use the final content for their own business marketing. This includes use on websites, social media, printed material, email campaigns, and internal presentations.
This licence does not permit the client to sell, resell, sub-license, or commercially redistribute the content.
3. Use of Third Parties
Clients may use third-party editors or support staff to help prepare the content for internal business use.
However, third parties must not:
publish or share the content publicly as their own
use the content in any personal or commercial portfolio
upload the content to platforms in a way that implies authorship
advertise any service using Lucy Digital’s content
materially alter the content in a way that misrepresents the original work
Any third-party involvement remains the responsibility of the client.
4. Credit Requirements
For online use, clients should credit Lucy Digital where reasonably possible (e.g. in social media captions, website footers, or press materials).
This is not legally mandatory, but it forms part of the licence terms.
5. Prohibited Use & Fees
The following actions are considered unauthorised use under UK copyright law:
a photographer, videographer, editor, or agency posting Lucy Digital’s images as their own
use of content in another professional’s portfolio
resale or commercial exploitation of the content
distribution of raw files to third parties for purposes other than internal business use
substantial alteration of the content without permission
Where unauthorised use occurs, the following fees apply:
5.1 Unauthorised Third-Party Publication or Portfolio Use
Use of imagery by another creative professional without permission will incur a fee of £150 per image or clip, or £450 per project, whichever is higher.
5.2 Unauthorised Commercial Use
If the imagery is used commercially outside the agreed licence, a fee equal to three times the original project value will be charged, reflecting the industry-standard UK penalty for unauthorised commercial exploitation.
5.3 Editing Misrepresentation
If the work is edited by third parties in a way that misrepresents Lucy Digital’s standard, a re-editing or withdrawal fee of £75 per asset may be charged.
These fees reflect industry norms, are compliant with UK copyright guidance, and serve as compensation for infringement.
6. Revocation of Licence
If licence terms are breached, Lucy Digital reserves the right to revoke usage rights until the matter is resolved.
This does not remove the client’s responsibility to pay for the original project.
7. Evidence & Enforcement
Lucy Digital may request the removal of any unauthorised use.
Failure to comply may result in legal action under UK copyright law, including a claim for damages.
Termination
1. Notice of Termination
Either party may terminate ongoing services by giving written notice in line with the notice period agreed in the original proposal or contract. All outstanding invoices must be settled in full before termination is completed.
2. Client Responsibility for Files and Content
Upon termination, it is the client’s responsibility to download and securely store any files held within their Lucy Digital Google Drive folder. This includes photography, videos, content assets, designs, reports, and documents.
Lucy Digital is not responsible for storing or archiving past files beyond the termination window.
All files held by Lucy Digital will be permanently removed within 14 days of the agreed termination date, unless otherwise agreed in writing.
Clients should refer to the Copyright & Usage section for the terms that continue to apply to all imagery, video, and creative work after termination.
3. Removal of Access and Credentials
Lucy Digital does not permanently store client passwords or login details.
At termination:
Lucy Digital will be removed from all Meta Business Suite accounts, TikTok accounts, social media logins, website logins, and any platforms previously granted access.
It is the client’s responsibility to revoke access or change passwords once services end.
No further posting, scheduling, account management, or content uploading will be carried out after the termination date.
4. Scheduled Content and Remaining Work
If notice is given part-way through a billing cycle:
All approved content already scheduled will remain scheduled unless instructed otherwise
Any unapproved content will not be completed
No new content will be created beyond the termination date
Refunds are not provided for unused days within a billing cycle, as all services operate on a retainer basis.
5. Ongoing Use of Content After Termination
Clients may continue using any content delivered prior to termination within the scope of the licence granted. This licence does not allow new third parties to claim authorship, edit work for commercial use, or use the content in their own portfolios.

6. Social Media and Branding Assets
Lucy Digital retains the right to use any content created during the project (including photography, video, design work, and strategy) for portfolio, case studies, and marketing unless otherwise agreed in writing.
7. Return of Physical Materials
If any physical documents or materials have been supplied, these will be returned or destroyed as agreed between both parties.
8. Final Confirmation of Termination
Termination is complete once:
all outstanding balances have been paid
all content has been downloaded by the client
Lucy Digital has been removed from all accounts
written confirmation has been sent to the client
At this point, no further responsibility is held for access, posting, asset management, or storage of files.
Additional Information
Lucy Digital holds the right to use all projects/designs and prints for marketing purposes.
Lucy Digital is not liable for indirect or consequential damages arising from our services.
When booking a service with Lucy Digital you are agreeing to all terms and conditions.
